Sure, here are three (3) non bankruptcy debt relief programs you can consider:

  1. Debt Settlement: For example, assume you owe your credit card company $25,000 (one hundred thousand dollars), you may be able to wipe out 50% or 60% or 70% or more of the debt. “How does this affect my credit rating?”

It’s a complicated question but the short answer is in order to have healthy credit you must eliminate the dangerous debt first. I show all of my clients – step by step – how to boost their credit score after the bad debt is eliminated. If you think by making your minimum payments, month after month, year after your, that means you have good credit, then you need to re-think what good credit means. Good credit is having little or no unsecured debt and a high credit score.

“What about IRS and State taxes? How do I deal with back taxes?”

It depends on your unique situation.  There are several options available to people owing state or federal government for back taxes.  Here are three of the options which might be available to you:

  1. Offer in Compromise. This is where you pay the government a reduced tax amount for a lump sum.
  2. Installment Agreement. Often a revenue agent will agree to more favorable terms to pay the tax back.
  3. Penalty and interest abatement. If you cannot get the principal reduced at least target the burdensome interest and late penalties.
  4. Bankruptcy. Bankruptcy may offer you tax relief in many cases.

 

“Is Bankruptcy right for me?”



Bankruptcy is a legal proceeding in which a person, business or a husband and wife who cannot pay their debts can get a fresh financial start.  The right to file for bankruptcy is authorized by federal law.  Filing bankruptcy immediately stops all of your creditors from calling you, writing you and seeking to collect debts from you until your debts are sorted out according to the law.  Bankruptcy may make it possible for you to:

Eliminate the legal obligation to pay most or all of your debts.  This is called a “discharge” of debts.  It is designed to give you a new financial start.

Stop foreclosure on your house or mobile home and allow you an opportunity to catch up on missed payments.  (Bankruptcy does not, however, automatically eliminate mortgages and other liens on your property without payment.)

Prevent repossession of a car or other property, or force the creditor to return property even after it has been repossessed.

Keep property (such as a car or furniture) from secured creditors and pay nothing for it or a fraction of what you owe.  A secured creditor is a creditor who has taken a mortgage or a car loan or other lien on property as collateral for the loan.  An unsecured creditor is usually debt like credit card debts or medical bills.

Force secured creditors, like your mortgage company or finance company, to take more convenient payment plans.

Stop wage garnishment, debt collection harassment, and similar creditor actions to collect a debt.

Restore or prevent termination of utility service.

Allow you to challenge the claims of creditors who have committed fraud or who are otherwise trying to collect more than you legally owe.

Get money back from creditors you have paid in the last 90 days.  Most people, and even some lawyers, don’t know this.  Our firm has successfully put money in our client’s pockets from money they paid to creditors.

A good debt and credit attorney will know how to work in your best interests.

“What property can I keep when I file bankruptcy?”

A good lawyer can protect all or most of your property from creditors even if you need to file for bankruptcy.  It is important to keep in mind that when you file for bankruptcy can be VERY IMPORTANT. Timing is everything . . . an experienced debt and credit lawyer can tell you when to file and if to file. Sometimes it is necessary to plan for bankruptcy and legally protect assets before filing for bankruptcy. If you have a debt problem, you want to take all legal steps before bankruptcy to protect your property legally.    

“Will I have to go to court?”

Not usually.  In most bankruptcy cases, you only have to go to a proceeding called a 341 hearing to meet with the bankruptcy trustee.  This is not a court proceeding.  Most of the time, this meeting will be a short and simple procedure where you are asked several questions about your bankruptcy forms and your financial situation.


“What about my credit? . . . Is my credit going
to be terrible after bankruptcy?”
